5. Refunds and Cancellations
– Due to the digital nature of our products, refunds or cancellations are generally not offered once a purchase has been made. Refunds or credits may be issued at our sole discretion under exceptional circumstances.
– Customers are advised to thoroughly review their selections before purchasing.
6. Termination and Suspension of Services
– Non-Payment: If payment for services is not received by the due date, Apex Web Services reserves the right to suspend or terminate access to the provided services. Clients will receive notification and must settle outstanding balances within 2 weeks (unless other terms are agreed upon in writing) to avoid termination of services.
– Abuse of Staff: Apex Web Services is committed to maintaining a respectful, safe environment for our staff. If a client engages in behavior that is abusive, threatening, or harassing towards our staff, we reserve the right to suspend or terminate their services immediately. No refunds of any sort will be dispersed in this type of scenario.
– Illegal Activities: Engaging in illegal activities directly or indirectly related to the services provided by Apex Web Services will result in immediate suspension or termination of those services. This includes, but is not limited to, hosting illegal content, using services for unlawful purposes, or purposely violating intellectual property laws.
7. Domain Name Management and Fees
– We do have strict policies due to the nature / complications involved with Domain Name management, but if the client communicates issues clearly, we have always been very flexible with difficult challenges.
– Non-Payment: If payment for domain name services is not received by the due date, Apex Web Services reserves the right to impose a late fee of $50/month until the balance is paid. Clients must settle outstanding balances within 2 weeks to avoid further actions.
– Recovery Fee: In cases where a domain name remains unpaid for 3 months or longer, and the client wishes to reclaim the domain after service suspension, a recovery fee of $50/month will be applied. This fee compensates for the administrative costs associated with maintaining the domain during the period of non-payment.
– Transfer and Redemption: Clients are advised to transfer their domain names prior to the termination of services if they wish to manage them independently. After service termination due to non-payment, the domain will enter a redemption period of 30 days as dictated by the domain registrar’s policies. During this period, the client may still recover the domain, subject to the redemption fees set forth by the registrar and our administrative fee of $50.
– Expiration: If the domain is not reclaimed or fees are not settled within the redemption period of 30 days, Apex Web Services reserves the right to take ownership of the domain to recover any unpaid fees. Legal action may be pursued to enforce this right where applicable.
8. Limitation of Liability
– Apex Web Services will not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use our digital products or services, even if we have been advised of the possibility of such damages.
9. Indemnification
– You agree to indemnify, defend, and hold harmless Apex Web Services and its employees from any claims, damages, expenses, or liabilities arising from your breach of these Terms and Conditions, your violation of any law, or your infringement of the rights of a third-party.
10. Governing Law
– These Terms and Conditions are governed by and construed in accordance with the laws of where Apex Web Services is registered, without regard to its conflict of law provisions.
